1. Using GRAILZ
You must be at least 18, provide accurate information, control the account you use, and have legal authority over every item you submit. You may not use the platform for stolen, counterfeit, altered, fraudulently obtained, or unlawfully transferred property.
2. Estimates are conditional
Online values, sold comps, liquidity scores, cash ranges, and timelines are estimates—not guarantees. A transaction becomes eligible for funding only after physical receipt, authentication, quality control, final valuation, and acceptance of the applicable offer schedule.
3. Separate transaction agreement
Each funded cash-out is governed by its signed Prepaid Consignment and Custody Agreement and item schedule. If these platform terms conflict with a signed transaction agreement, the signed transaction agreement controls for that cash-out.
4. Selling remains off
Creating an account, submitting an item, requesting an offer, or signing a custody agreement does not by itself authorize a sale. A listing requires a separate resale authorization identifying the method, fee rate, price or reserve, and protected payout.
5. Accounts and signatures
You are responsible for activity performed through your authenticated account. Electronic acceptances and typed signatures may create binding records. Do not sign for another person unless you have documented legal authority.
6. Uploaded content
You grant GRAILZ a limited right to process submitted photographs and item information to identify, authenticate, value, insure, store, market, or service the requested transaction. You retain ownership of your original content, subject to rights needed to operate and document the service.
7. Prohibited conduct
You may not interfere with the platform, test unauthorized access, submit malicious code, manipulate market data, impersonate another person, evade account restrictions, abuse promotions, or use automated systems to overload or scrape protected services.
8. Third-party services
The platform may rely on authentication, pricing, grading, marketplace, vault, carrier, insurance, and payment providers. Their services and terms may apply separately. GRAILZ is not responsible for an independent provider's services beyond responsibility imposed by the signed transaction agreement or applicable law.
9. Suspension and termination
GRAILZ may restrict an account or refuse a transaction for fraud risk, sanctions, identity concerns, suspected stolen property, abuse, legal requirements, or material violation of these terms. Existing custody and payment duties survive account closure.
10. Disclaimers and liability
The platform is provided on an as-available basis. To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages. Nothing here limits liability that cannot legally be limited, including liability for fraud, willful misconduct, or obligations expressly assumed in a signed custody agreement.
11. Arizona law
Arizona law governs these platform terms, without regard to conflict rules. Unless mandatory law or a signed agreement requires another forum, disputes concerning the platform will be brought in state or federal courts located in Maricopa County, Arizona.
12. Changes
Material changes will be posted with a new effective date. Changes do not retroactively rewrite an already signed transaction agreement. Continued platform use after the effective date accepts the updated platform terms.
